Un statut d'emploi pour un enjeu social - La professionnalisation des assistantes maternelles
Résumé.
Dans le cadre du redéploiement du régime d'Etat-providence amorcé depuis plusieurs années, des activités tendent à se professionnaliser,
générant ainsi des emplois et de la protection sociale. La situation des assistantes maternelles semble à ce titre symptomatique. En effet,
les assistantes maternelles symbolisent la reconnaissance en compétences professionnelles d'activités longtemps associées aux activités
domestiques et familiales réalisées au sein de la sphère familiale. l'actuel projet de loi concerne près de 300.000 personnes qui pourraient
ainsi prétendre à un véritable statut professionnel d'emploi. Cet emploi est au coeur de l'articulation entre vie professionnelle et
familiale. Véritables "agents de conciliation" pour de nombreuses mères actives, les assistantes maternelles sont souvent
elles-mêmes mères et actives, leur relation d'emploi étant au centre de l'articulation. Ce sont les parents, articulant par leur intermédiaire
leur vie familiale et professionnelle, qui emploient et gèrent la relation d'emploi de ces assistantes maternelles, et constituent à ce titre
une catégorie spécifique d'employeurs, les "parents-employeurs". Sont analysées ici les caractéristiques spécifiques de cette
relation d'emploi, ainsi que les conditions de la professionnalisation. Mais au-delà de la volonté institutionnelle, des ambiguïtés demeurent,
notamment autour de la reconnaissance des compétences. La difficulté à créer un réel consensus social tenant sans doute à la nature
particulière de l'emploi mais aussi aux intérêts des parties en présence : les assistantes, les parents-employeurs et l'Etat. Et au-delà de
l'instauration d'un statut d'emploi semble se jouer un réel enjeu social, à travers l'articulation des politiques d'emploi et des politiques
familiales, et la poursuite d'objectifs multiples. En particulier, le projet de loi peut être vu comme la participation de l'Etat à la
"gestion de la parentalité", dans le cadre de l'institutionnalisation de procédures visant à une meilleure conciliation entre la vie
professionnelle et la vie familiale des travailleurs.
Abstract.
Within the redeployment of Welfare state regime started for several years, some activities have tended to professionalize, thus
generating employment and social protection. The situation of the maternal assistants seems symptomatic of this phenomenon.
Indeed, the maternal assistants symbolize the recognition in professional skills of activities associated a long time with the
domestic and family activities carried out within the family sphere. The current bill concerns nearly 300.000 people who could
thus claim with a true professional status of employment. This job is central in the articulation between working and family
life. True "agents of conciliation" for many active mothers, the maternal assistants are often themselves mothers and
active, their relation of employment being in the core of the articulation. The parents articulate by their intermediary their
family and professional life, employ and manage the employment relation with these maternal assistants, and constitute a
specific of employers, the "parent-employers". The specific charateristics of this relation of employment are analyzed
here, as well as the conditions of the professionalizing process. But beyond the institutional will, some ambiguities remain, in
particular about the recognition of competences. The difficulty of creating a real social consensus undoubtedly holding with the
particular nature of employment but also with the interests of the involved parts : assistants, parent-employers and the State.
And beyond the introduction of an employment status, a real social stake seems to be played through the articulation of the
employment policies and the family policies, and the continuation of multiple goals. In particular, the bill can be seem like
the participation of the State in the "management of the parenthood", within the institutionalization of procedures
aiming at a better conciliation between the professional life and the family life of the workers.
