quels effets en attendre ?

Résumé. Cet article évalue les apports récents de la théorie économique concernant les effets du renforcement international des droits de propriété industriels (DPI), à la suite notamment des accords TRIP. En premier lieu, nous nous plaçons dans un cadre statique et montrons qu'un tel renforcement doit engendrer, toutes choses égales par ailleurs, une redistribution des revenus en défaveur des pays du Sud. En second lieu, nous analysons les effets ambigus du renforcement des DPI sur les flux de commerce et d'investissement direct entre le Nord et le Sud. Enfin, nous considérons l'influence des DPI, sur l'incitation à innover des firmes du Nord, ainsi que les externalités positives de la protection.

Abstract. This article examines recent theoretical and empirical works regarding the effects of an international strengthening of intellectual property rights (IPR), mainly in wake of the TRIPs agreement. In a static analysis, we show that other things equal, the strengthening should deteriorate the welfare of Southern, imitating countries. Then, we examine the ambiguous effects of the strengthening on trade and foreign direct investment. Finally, we consider the influence of IPR protection on the innovation incentives of Northern firms and devote a special attention to the "positive externalities of protection".
